That's right, ladies and gentleman, SUPREME COURT appointments by recess appointment.
Now, they were later confirmed, but could easily have been rejected by the Senate, as Chief Justice John Rutledge was (George Washington recess appointment), and Rutledge continued to serve as Chief until his commission expired. (Rutledge was an associate justice when nominated to be chief)
Earl Warren - recess appointed October 5th 1953; nominated January 11th 1954; confirmed March 1st 1954
William Brennan - recess appointed October 16th 1956; nominated January 14th 1957; confirmed March 19th 1957
Potter Stewart - recess appointed October 18th 1958; nominated January 17th 1959; confirmed May 5th 1959

Everyone needs to demand that their Senator come home and be physically accountable to those who voted for them. Pressure them into taking a recess vacation or be denounced by the people.
I know... Like they care right?
