The scope of Title IX has been expanded by the Biden Administration to include protections for sexual orientation and gender identity, which marks a significant shift from its original intent of ensuring equal opportunities for women in educational settings when it was enacted in 1972.

Title IX was created to provide equal access to educational resources and opportunities for women, including sports programs and academic pursuits. However, its interpretation and implementation have evolved over time to reflect societal norms and values.

The recent update to Title IX signifies a move towards addressing discrimination based on sexual orientation and gender identity, which is in alignment with the administration's "commitmentto advancing LGBTQ rights and promoting inclusivity in educational institutions.

R. Shep Melnick, a professor of American politics at Boston College, told the New York Times“One of the things that’s interesting about Title IX is how, with its original goals, how fully it succeeded, more so than any other civil rights law, And suddenly, the focus changed from ‘what were the opportunities within the educational institutions’ to ‘how are we going to change how people think about sex, gender, and generally how we’re going to undo stereotypes.’”

The Final Rule update to Title IX, issued by the U.S. Department of Education, expands the scope of the law to forbid discrimination based on “sex stereotypes, sexual orientation, gender identity, and sex characteristics.”

Under the new rule, schools are required to respond to all complaints of sex discrimination on time with a “fair, transparent, and reliable process” that includes impartial decision-makers who evaluate all relevant and admissible evidence.

Furthermore, schools must communicate their policies and procedures regarding non-discrimination to all students, employees, and other participants in their educational programs to ensure that students and families are aware of their rights.

In a statement, Assistant Secretary for Civil Rights Catherine E. Lhamon said, “These final regulations clarify Title IX’s requirement that schools promptly and effectively address all forms of sex discrimination. We look forward to working with schools, students, and families to prevent and eliminate sex discrimination.”

Despite these efforts, certain issues, particularly regarding male students attempting to compete in women’s sports, a topic that has been at the forefront of the transgender movement in recent years, remain unresolved. While the Department of Education has proposed amendments to address this issue, the final decision is still pending.

In April 2023, the Department put forward some revisions to its athletics regulations. The proposed changes were met with over 150,000 public comments, which, by law, must be taken into account. The Department is obliged to give careful consideration to each of these comments.

The regulations states:

“Participation in school athletics is an important component of education and provides valuable physical, social, academic, and mental health benefits to students. The proposed rule affirms that students benefit from the chance to join a school sports team to learn about teamwork, leadership, and physical fitness. The proposed rule would establish that policies violate Title IX when they categorically ban transgender students from participating on sports teams consistent with their gender identity just because of who they are. The proposed rule also recognizes that in some instances, particularly in competitive high school and college athletic environments, some schools may adopt policies that limit transgender students’ participation. The proposed rule would provide schools with a framework for developing eligibility criteria that protects students from being denied equal athletic opportunity, while giving schools the flexibility to develop their own participation policies.”

Critics of the expanded Title IX argue that it represents an overreach of government authority and undermines traditional values. They assert that by including sexual orientation and gender identity as protected categories, the administration is eroding the biological basis of sex and promoting a radical agenda.

Riley Gaines, the former collegiate swimmer who is determined to oppose the participation of men in women's sports, expressed strong dissatisfaction with the new Final Rule and is concerned about what could still be coming from the Biden Administration.

Moreover, concerns have been raised about the potential infringement on free speech and due process rights due to the new rule's mandate of preferred pronouns and disciplinary measures for violations, which raises questions about academic freedom and individual expression.

The Biden Administration's egregious expansion of Title IX to include sexual orientation and gender identity is a flagrant abuse of power and a direct assault on traditional American values. By prioritizing the interests of the LGBTQ community over the foundational principles of sex-based rights, the administration has not only distorted the original intent of Title IX but has also endangered the very fabric of our society.

This tyrannical move represents the pinnacle of leftist extremism, as Biden and his cronies seek to impose their radical agenda on every aspect of American life. By mandating the use of preferred pronouns and threatening disciplinary action against those who dare to speak out against this travesty, the administration has effectively declared war on free speech and individual liberty.

Furthermore, the Biden Administration's refusal to address the issue of transgender participation in sports is a blatant betrayal of women's rights and a slap in the face to female athletes everywhere. Allowing biological males to compete against women not only undermines the integrity of women's sports but also poses a significant threat to the safety and fairness of athletic competition.

Although Gaines and he tied, he was given the trophy by the NCAA. This absurdity highlights the absurdity of the administration's policies and the real-world consequences they entail.
