Halle Berry denied ever harming her child after her ex-husband accused her of abusing their 13-year-old son, Maceo.
Olivier Martinez filed for sole custody of Maceo after alleging that Berry “physically abused” him during a heated exchange Sept. 26. Martinez detailed other alleged “instances of abuse” in his court filing, according to TMZ.
Berry filed a declaration Oct. 5, stating, “I have never physically, emotionally, or otherwise abused Maceo. I am a victim of domestic violence, and I help victims of domestic violence,” according to People.
Berry continued, “I am not a perpetrator of violence. I would never hurt our child.”
Martinez alleged that Berry became physically violent toward their son after becoming upset that he was gaming, and said the actress put him in a chokehold. He claimed Berry texted him after the alleged exchange and submitted the evidence as part of his court filing.
Berry denied Martinez’s claim and submitted video evidence that she said “directly contradicts” his version of events, according to People. She claimed she and Maceo were “playfully roughhousing” as they “frequently do,” but he “unexpectedly” became upset and pushed her after he realized she was video recording.
She continued, “My text messages to Olivier reflect my distress after Maceo became physically aggressive toward me, not any physical conduct by me toward Maceo,” Berry said, according to People.
Berry’s filing claimed Martinez didn’t raise any concerns during a school meeting they both attended Sept. 30 at Maceo’s school. She further claimed he was “at ease” with modified visitation the following week, for Maceo’s 13th birthday.
Martinez filed for sole custody and was granted a temporary restraining order. Berry subsequently applied to restore their 50/50 custody agreement, according to People.

Berry said Maceo is neurodivergent and can be “angry” and “combative” when he returns from a stay with his father. She said he requires professional help, but claimed she and Martinez do not agree on how to move forward with his care.
