Halle Berry’s daughter is expected to testify in the ongoing domestic violence restraining order case between the actress and her ex-husband, Olivier Martinez.
Berry, 60, appeared to have red and watery eyes as the courtroom reopened Monday afternoon following 13-year-old Maceo’s nearly four-hour testimony.
Both Berry and Martinez, 60, will testify in the case. Berry’s 18-year-old daughter, Nahla, whom she shares with model Gabriel Aubry, 50, was also listed as a potential witness.
If Nahla testifies, it will take place virtually because she is currently attending school.
In a previous court declaration obtained by Page Six, Nahla wrote that she has never witnessed her mother “hit, slap, choke, grab, or physically abuse Maceo in any way.”
“I have never seen my mom place her hands around Maceo’s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her,” she added.
Additional potential witnesses could include Berry’s fiancé, Van Hunt, staffers at Maceo’s school and other therapists and medical professionals.
Berry’s attorney referenced the “minor’s propensity for dishonesty” as a reason to bring in certain witnesses.
The courtroom will be closed during any testimony involving Maceo or “sensitive medical issues.”
When Judge Shelley Kaufman asked if both parties’ declarations were agreed upon, Martinez’s legal team claimed Berry’s is “riddled with hearsay” and requested it not be entered as evidence.
Berry’s legal team argued the declarations were not hearsay, but explained why Martinez filed the “frivolous and baseless” domestic violence restraining order application and how his intent was to circumvent court orders.
Despite the earlier emotions, Berry left court smiling after Monday’s developments, while Martinez walked out without acknowledging his ex.
The hearing will resume at 10:30 a.m. Tuesday.
