A trans-identified male has lost an employment discrimination case after alleging that he had been wrongfully fired from his job at a childcare center in Letterkenny. The Workplace Relations Commission found that Aleena Starshine had been terminated not due to his gender identity, but as a result of repeat parental complaints and concerns about child safeguarding.
According to the Commission’s report, Starshine was first hired to the Craoibhin Community Enterprise Centre on November 7 of 2024. The Centre is a community-based facility focused on providing créche and after-school programs to children from 6 months to 12 years of age.
Within one week of being hired, two separate complaints of a serious nature had been lodged against Starshine, who was placed to work with children from 5-12 years of age.
The first complaint pertained to a “safari game” Starshine had organized with the children, during which he offered an 11-year-old child “a free kiss from me” or a “big kiss” as a prize. The child reported this to a parent, who then filed a complaint with the facility. An investigation was launched, and Starshine was confronted about the comment and admitted to making it.
Facebook posts shared by Starshine rail against JK Rowling, TERFs, and those who suggest trans people are pedophiles.According to a submission to the Workplace Relations Commission by a representative of the Craoibhin Community Enterprise Centre, investigators were particularly concerned at this point because Starshine did not appear to “appreciate or understand why the comment was problematic in a safeguarding context.”
The next incident involved yet another safeguarding concern in which Starshine reportedly released a child to the care of an adult during a pickup without verifying the adult’s relation to the child or having any other adults present. When confronted, Starshine once again “did not accept that any safeguarding issue arose, instead characterising the practice as normal.”
Following the second incident, Starshine was suspended with full pay while a thorough investigation was conducted. The Child and Family Agency (Tusla) was also notified of the complaints against Starshine, and his employment was ultimately ended in February of 2025.
In July of 2025, Starshine filed a complaint with the Workplace Relations Commission alleging he had been discriminated against on the basis of his gender identity.
The background of the complaint, which refers to Starshine using feminine pronouns, reads that he “alleges that she was discriminated against on the gender ground.”
In his rendition of events, Starshine was dismissive of the complaints against him, and even suggested that the mother of the child he admitted to offering to “kiss” was transphobic.
“The letter in the original complaint is highly suggestive of gender discrimination. The author of that letter was [NAME REDACTED BY REDUXX]. She is the mother of a child who uses the Respondent’s service. She was the mother of the child who was offered a free kiss,” Starshine wrote in his complaint to the Commission.
The Workplace Relations Commission case was adjudicated by Niamh O’Carroll, who determined that Starshine had failed to demonstrate he had been the victim of discrimination.
“There are no facts before me from which I could conclude that the Complainant’s employment was terminated on discriminatory grounds related to gender,” O’Carroll wrote in her decision. “The evidence before me clearly demonstrates that the Complainant did not successfully complete her probationary period due to concerns regarding her professional judgement, safeguarding awareness, and recognition of appropriate professional boundaries, and for no other reason.”
