Protein bar company pivots to selling $15 ice cream after being slammed with lawsuit over calorie content

Controversial protein bar company David is launching new protein-packed 'frozen desserts' online, despite being at the center of an ongoing lawsuit. 

These high-protein frozen pints are similar to ice cream in texture and consistency, but with fewer calories and even more protein. 

'The goal was simple: make the best-tasting frozen dessert possible,' David founder Peter Rahal said in a statement. 'Then make it David: as much protein and as few calories as physically possible.'

The pints are already available on the company's website and are sold in packs of six for $90, but health-conscious fans will have to wait a little longer before sampling - upon launch, David Frozen Dessert sold out in just 28 minutes.

For those who want to taste the flavors before committing to six pints, David will open a limited-time ice cream shop at S10 Gym in New York City's West Village. 

With a June 5 opening date, this storefront will serve the full frozen dessert lineup, although there's no word regarding how long it will be open.

There are several new flavors in this collection, like Cookie Dough (30g protein, 260 calories, 2g sugar per pint), with a vanilla base, soft cookie dough chunks, chocolate flakes and dark chocolate swirls.

Triple Peanut Butter is a peanut butter base with peanut butter flakes and peanut butter ribbons, with 30g protein, 260 calories and 2g sugar per pint.

Triple Chocolate has a chocolate base, chocolate flakes and chocolate swirls, with 30g protein, 260 calories and 2g sugar per pint.

Vanilla bean, which has specks of vanilla bean, is 30g protein, 210 calories and less than 1g sugar per pint. For comparison, Ben and Jerry's vanilla ice cream is 1120 calories per pint with 17g of protein.

This announcement comes just weeks after David was caught up in a class action lawsuit claiming the calories and fat content in their products was misleading. 

Founded in September 2024 by entrepreneur Peter Rahal, the bars are marketed as a breakthrough product and lifestyle staple for health-conscious consumers.

David Protein uses a blend of milk protein isolate, collagen, whey concentrate and egg white to create its bar, that the company says has just 2 grams of fat. 

But according to the lawsuit, filed January 23 in federal court in New York, lab testing found the bars actually contain 11 to 13.5 grams of fat.

The three plaintiffs allege that they - and other consumers - paid a premium for the bars under the assumption that the nutrition information on the packaging was accurate.

They are now seeking damages, refunds, and a court order compelling the company to stop selling products with allegedly misleading nutrition labels. 

'We stand behind the accuracy of our product labeling, which complies with FDA requirements for measuring and reporting nutritional content,' Rahal told Vanity Fair in January. 

David Protein’s bars found its footing amid the protein-forward diet craze, promising 28 grams of protein, zero sugar and just 150 calories in its bars. 

The products are still available for purchase online and at major grocery stores - a pack of 12 David protein bars is available on Amazon for $39.
