The daughter of a Senate Republican has applied for a restraining order from her GOP Congressman ex-husband amid a nasty legal battle.
Emily Moreno, daughter of Ohio Senator Bernie Moreno and ex-wife of Ohio Congressman Max Miller, filed an application for a restraining order on behalf of her attorney, Andrew Zashin, after Miller allegedly harassed the lawyer.
The former couple, who have been in a custody battle over their daughter, already have restraining orders against each other.
She has accused Miller of years of documented physical abuse, including allegations that he harmed their young child. The couple reached a divorce settlement in June 2025.
Miller has denied all of the allegations and brought a countersuit against Moreno alleging that he was the victim of domestic abuse.
A judge threw Miller's case out this week, claiming that the Congressman had not been hurt or in fear of his safety. Miller filed to drop his case in May, but his request was not fulfilled until Wednesday. Miller has also accused Moreno of defaming him and abusing their child.
In the court filing released on Thursday, Moreno claims that Miller's counsel, Larry Zuckerman, stated earlier this week that the Congressman 'just can't control himself.'
She also claims that Miller 'has harassed, threatened, and communicated directly' with Moreno's current attorney Zashin and past legal teams. Further, she alleges that Miller physically touched Zashin without consent.

'Unless restrained, Plaintiff (Miller) will continue to harass, threaten, and communicate with my counsel directly,' Moreno claims in the filing.
Neither Moreno nor Miller's legal teams responded to the Daily Mail's request for comment. Miller's congressional office also did not respond to a request for comment.
The application for the latest restraining order this week comes on the heels of allegations that Miller tried to 'goad' one of Moreno's attorneys into a confrontation.
The Daily Mail was the first to report on a slew of alleged violence between the formerly married couple.
A recent alleged attack came on February 1 of this year when Miller allegedly grabbed and struck Emily, 32, during a custody exchange at his Ohio home, leaving bruises on her arm, elbow and torso as the couple's two-year-old daughter Ruth looked on.
An earlier incident on June 9, 2024, involved the Congressman allegedly hurling a pot of boiling water at Emily during an argument inside their Ohio home, with some of the water striking her chest, while their then-eight-month-old daughter was present, Moreno has claimed in legal filings.
Miller has denied all wrongdoing and said that Moreno 'isn't all there.'
He also recently denied that the allegations against him will impact his re-election bid.

'Texas is turning blue like I’m losing my seat,' he told the New York Times. 'Take a hike. After I win by more than my district, don’t bother ever contacting me again.'
He has also been defended by his GOP colleagues.
'This is a family matter,' House Judiciary Chairman Jim Jordan told CNN on Thursday. 'I know Max is a good man.'
Emily moved on March 4 to overhaul the custody arrangement entirely, citing her ex-husband's 'dangerous physical behavior' in their daughter's presence.
'Max Miller is a nightmare who is spiraling out of control and everyone in Washington knows it,' a source familiar with the couple's marriage previously claimed to the Daily Mail.
'He's still just a spoiled rich kid at heart who has had everything handed to him on a silver platter and lashes out at anyone who dares to tell him no.'
According to court documents referencing the February 1 incident reviewed by the Daily Mail and three separate sources, Emily arrived to pick up their daughter, Ruth, when an argument broke out. The exact nature of the argument is unclear.
The confrontation escalated when Miller allegedly grabbed and hit Emily, causing bruising to her right arm, elbow, and torso in front of Ruth, sources claim.
Photos obtained exclusively by the Daily Mail show the injuries Emily documented on her arms and torso the day of the alleged incident, with additional images taken the following day, February 2.
