So the negligent manslaughter charge is left.

That’s a big deal, as that is not normally an imprisonable offense.

Let’s hope the jury continues to deadlock on that one.

Bragg knew he would NEVER be convicted of manslaughter so he hopes the jury splits the baby so to speak and convicts Penny of criminal negligent homicide

I am not a lawyer, but this sounds like solid grounds for an appeal. The prosecution has already introduced a boatload of evidence that was supposed to support a manslaughter charge. How would this not be considered prejudicial evidence if that charge is now dropped? I think this would require them to start the case all over again.

This is not cause for celebration. Bragg is saying, “Okay, you can’t come to a conclusion on the manslaughter charge, fine. I WILL have my conviction, so since you can’t decide on the manslaughter conviction - which is needed before you can consider the criminal negligence charge - I will make it go away to force you to consider the criminal negligence charge. And since you want to go home for the weekend, I’m sure you’ll ‘make the right decision.’”

Bragg is pulling out all the stop to get *some* conviction, any conviction. This is BS and Penny’s defense has already filed for a mistrial based on this.

Jury can’t consider the lesser charges until they return a unanimous verdict on the manslaughter charge. If they are hung on the manslaughter charge then a mistrial will have to be declared. Never heard of dismissing a charge in the middle of jury deliberations, but this is NYC and the judicial system is so corrupt the ploy may work.

In my 40 years as an attorney, both as a prosecutor and defense attorney, I have never seen a case where the DA dismisses a charge when the jury has hung up on the greater charge. The Judge should have denied the motion. This is bush league stuff.

The Leftist Democrat Prosecutor needs to secure a Guilty verdict, even it involves a lesser charge.
