CV NEWS FEED // Biden-Harris administration-appointed Special Counsel Jack Smith filed to dismiss a series of charges against President-elect Donald Trump on Monday – a development widely seen as a victory for Trump.
The New York Post reported that Smith not only “moved to dismiss the charges against Donald Trump related to the Jan. 6 riots,” but also moved “to end its appeal of” Judge Aileen Cannon’s July decision “nixing Smith’s classified document case against Trump.”
Smith wrote in a court motion to dismiss an “election interference” case against Trump on Monday: “It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President.”
“The Department’s position is that the Constitution requires that this case be dismissed before the defendant is inaugurated,” the controversial special counsel added. “This outcome is not based on the merits or strength of the case against the defendant.”
Smith’s motions come three days after the judge in the heavily scrutinized New York City “hush money” case against Trump indefinitely delayed sentencing the president-elect on the 34 counts of falsifying business records. Trump was controversially convicted on the felony counts in May.

Trump’s incoming White House Communications Director Steven Cheung wrote in a Monday statement following Smith’s motions: “The American People re-elected President Trump with an overwhelming mandate to Make America Great Again.”
“Today’s decision by the DOJ [Department of Justice] ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law,” Cheung added. “The American People and President Trump want an immediate end to the political weaponization of our justice system and we look forward to uniting our country.”
Vice President-elect JD Vance took to X (formerly Twitter) to posit that had Trump lost the presidential election to Democratic nominee Kamala Harris, “he may very well have spent the rest of his life in prison.”
“These prosecutions were always political,” Vance emphasized. “Now it’s time to ensure what happened to President Trump never happens in this country again.”
