US federal prosecutors are preparing new charges against Venezuela’s former leader Nicolás Maduro and his wife, Cilia Flores, over the alleged torture of Americans held in Venezuelan prisons, US media report. The charges could be announced as soon as Thursday, but none had been filed when we checked.

What We Know

CNN reported the plan first on Wednesday 7 October 2026, and CBS News later cited multiple people familiar with the case. Brazil’s Jovem Pan carried the report that evening.

Those people say prosecutors expect to charge Maduro and Flores over the treatment of more than a dozen US citizens wrongfully detained in Venezuela. Others could be charged as well, according to the reports.

Matthew Heath and Osman Khan, two Americans freed in October 2022, have publicly described electric shocks and simulated drowning during their detention. Those are their own accounts, and they are not charges.

Maduro’s lawyer, Barry Pollack, told CBS News he has received no notice that more charges could be coming. A Justice Department spokesperson did not immediately respond to a request for comment, CBS reported.

The Case So Far

In January 2026 the Justice Department unsealed a superseding indictment against Maduro, Flores and other Venezuelan nationals in the Southern District of New York. Maduro faces narco-terrorism conspiracy, cocaine importation conspiracy and weapons charges, and US reporting says Flores faces the cocaine and weapons counts.

Both defendants have pleaded not guilty, and the trial is set for 1 June 2027 in Manhattan. Flores is due in federal court on Thursday 8 October 2026 for a hearing on her request to be moved from jail to house arrest because of health problems.

On Polymarket, the market asking whether Maduro is found guilty of all counts stood at 33.5% on 8 October 2026 at 00:32 ET, with about US$133,000 traded. A second market, on whether Flores is released from custody by 31 December 2026, stood at 7.0%, and the event’s markets together had about US$1.38 million traded.

What Is Not Known

Prosecutors have not said which law the new charges would use, who else might be named, or whether they would come as a new indictment. We have not seen a response from the Venezuelan government.

It is also unclear whether the court will rule on Flores’s request on the day of the hearing. No date has been reported for any court appearance on new charges.

What It Means for Travelers and US Readers

If the charges are filed, they would add the treatment of detained Americans to a case that so far centres on drugs and weapons. The wrongful detention of US citizens would then be part of the court record as well as of US-Venezuela diplomacy.
