The Department of Justice declared that the Equal Employment Opportunity Commission's (EEOC) disparate-impact guidelines are unconstitutional.

Disparate impact is a legal theory used by the Left to argue that a hiring practice is discriminatory if it results in significantly fewer minorities being hired than white applicants, even without evidence of intentional discrimination.
