Federal investigators have obtained DNA evidence in an attempt to prove accusations that Rep. Ilhan Omar (D-MN) married her brother and committed immigration fraud, according to The New York Post.
On Monday, the Post reported that investigators were using DNA, government records, and information from whistleblowers to investigate possible immigration fraud involving Omar and her family.
One source said the DNA evidence was critical to establishing whether her former husband, Ahmed Nur Said Elmi, is her biological brother. Omar married Elmi in 2009, separated from him in 2011, and divorced him in 2017. She has denied the allegations.
The Post did not explain how investigators obtained the DNA or whether they collected it before or after the October 12 Homeland Security Investigations search of Omar’s Washington, D.C., home.
One source disputed earlier reports that investigators had searched through trash to obtain the DNA samples, while two others told the Post that last week’s search, combined with the DNA evidence and other findings, had given prosecutors a solid basis to bring an immigration fraud conspiracy case before a grand jury.
No indictment has been announced.
Elmi, who lives in the United Kingdom, reportedly applied for a marriage-based green card before withdrawing his application in 2019 after immigration officials requested more evidence about the marriage, according to Washington Post reporting cited by the New York Post.
The investigation also involves whether Omar or her father misrepresented her birth date in immigration paperwork. Daily Wire investigative reporter Luke Rosiak previously noted the statute-of-limitations obstacle to prosecuting the marriage itself, while distinguishing that issue from questions about whether Omar obtained her own citizenship through fraud.
Border czar Tom Homan said Saturday that he had been told investigators had “a strong case.” He said Omar could face denaturalization and deportation if the evidence established immigration fraud.
Omar’s attorneys wrote in an October 16 letter to federal prosecutors that there is “no legitimate basis for any suggestion that she has violated any law concerning her citizenship status,” according to The Associated Press.
“This vindictive, retributive, and politically motivated criminal investigation into one of the President’s chief congressional critics violates Representative Omar’s constitutional rights and threatens the separation of powers,” Omar’s attorneys wrote in the same letter.
The attorneys also asked authorities to immediately return property seized during the raid at her home, claiming the search was “neither justified nor lawful.”
A spokesperson for the DOJ said the letter was “riddled with false allegations and inaccuracies,” the Post reported.
