KJ Biermann has requested that a Georgia judge reconsider a previous motion in his sexual battery and sodomy case.
In court papers obtained by Page Six, the 15-year-old filed a “motion for reconsideration of the court’s October 5th, 2026” order on Oct. 14. The actual motion and order are currently under seal from the public.
A second filing to a “request for certificate of immediate review of the court’s October 5th, 2026” order was also filed under seal.
A hearing took place in the case on Oct. 14, as Page Six confirmed Biermann was not required to attend.
This comes after the teen officially pleaded not guilty to all of the seven felony charges against him in his sexual battery and sodomy case, as he waived his formal arraignment.
Biermann’s lawyer, Jason Sheffield, requested the hearing date be transferred to Fulton County Juvenile Court.
Biermann — whose real name is Kroy Biermann Jr. — was arrested on Aug. 17 for aggravated sexual battery, aggravated sodomy, aggravated child molestation, three counts of aggravated sexual battery against a child under 16 and false imprisonment.
Kim Zolciak and her estranged husband Kroy Biermann’s oldest son was accused by a female classmate — who described herself as his girlfriend’s “best friend” — of sexual assault at a Life Time fitness center in Alpharetta, Georgia in April.
According to the Alpharetta Police Department, the classmate claimed KJ forced himself on her and attempted “multiple times to have sexual intercourse with her by trying to pull down her pants.”
She claimed KJ forced her to give him oral sex before he digitally penetrated her vagina. When she allegedly was able to get away from him, he “pulled up his pants and left.”
The teen was examined at a medical center, but no evidence of male DNA was found in her mouth or vagina, according to authorities.
KJ was arrested and detained at Atlanta’s Metro Regional Youth Detention Center for over a month and was released on $200,000 bond in September.
He is to follow strict rules, including staying at his mother’s home and attending school virtually.
KJ is banned from social media and is not allowed to use a cellphone. He is also unable to have direct or indirect contact with the victim, her family and associates, as well as contact with anyone under the age of 16.
Sheffield has maintained his client’s innocence and Zolciak has spoken out in defense of her son, calling the allegations “reckless and deeply troubling.”
During KJ’s initial hearing, prosecutors claimed to have discovered footage on his cellphone that showed him having sex with a family member under the age of 12.
KJ’s lawyer told Page Six regarding the new claim, “The matter arose from inappropriate, crude behavior involving two middle schoolers. It did not result in an adjudication for statutory rape, sexual intercourse or any comparable offense.”
Zolciak and Kroy — who are currently in a tumultuous divorce — share Kash, 14, and 12-year-old twins Kane and Kaia. The former NFL player adopted her two daughters, Brielle, 29, and Ariana, 24.
