Olivier Martinez requested a judge block Halle Berry’s daughter, Nahla Aubry, from testifying in the exes’ custody drama over their son, Maceo.
“Ms. Aubry does not have any significant bearing on this case,” the French actor, 60, claimed in court documents obtained by Us Weekly.
“Ms. Aubry is unquestionably biased. I do not believe it is appropriate for [Berry] to try to insert her daughter into litigation that does not involve her,” the docs stated.
However, Martinez wants Maceo to “address the court” and tell his side of the story regarding allegations that his mom, 60, abused him.
“Given that our son is 13 years old, I believe it would certainly be in his best interest for him to address the court at this time,” Martinez claimed in court documents.
“He should have the opportunity to have his voice heard regarding what he experienced that night. … I believe that our son’s testimony will be the key to the Court learning the full truth about the events that occurred on September 26th,” he added.
“I am the parent who wants the truth to come out. I am the parent who does not want to suppress Maceo’s voice.”
Page Six reached out to Berry’s legal team but did not immediately hear back.
Last week, Page Six exclusively reported that Nahla, whom Berry shares with model Gabriel Aubry, gave a rare statement in court docs, defending the “Catwoman” star.
The 18-year-old described the actress as a “loving and devoted parent” who “can be strict when necessary.”
Nahla also claimed she never saw Berry “hit, slap, choke, grab, or physically abuse Maceo in any way.”
“I have never seen my mom place her hands around Maceo’s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her,” the teen claimed in the declaration.
Last month, Martinez filed a temporary restraining order against the “Monster’s Ball” actress, accusing her of physically abusing Maceo — claims she vehemently denied.
In the docs obtained by Page Six, the “Unfaithful” actor claimed the Berry allegedly jumped on Maceo and put her hands around his neck and choked him.
Martinez claimed that a panicked Maceo called him to pick him up after the alleged incident — and the “traumatized” teen allegedly told his dad he didn’t want to return to his mom’s house.
After the filing, Martinez was granted primary custody of Maceo and the Oscar winner lost 50/50 custody in lieu of daytime visits with the child.
Berry was ordered to only see Maceo two days a week and every other weekend. She was also ordered to stay more than 100 years of her ex.
On Oct. 5, Berry was spotted heading to Sky Zone with Maceo and her fiancé, Van Hunt.
The “X-Men” star and her third husband, Martinez, were married from 2013 to 2016.
